These Terms of Service (“Terms”) explain the rights, responsibilities, and conditions that apply when you access our webshop, place an order, or use the services available through fiveluxx.com and related pages (the “Services”).

FIVE LUXX is a brand owned and operated by Luxx Commerce ApS, a company registered in Denmark. These Terms are designed to provide clear information about ordering, payment, shipping, returns, product availability, warranties, privacy, and dispute handling. Nothing in these Terms limits any mandatory consumer rights that apply under applicable law.

By accessing the Services or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, you must not use the Services or place an order.

1. Scope of These Terms

1.1 These Terms apply whenever you access or use the Services, create an account, place an order, or otherwise interact with FIVE LUXX through fiveluxx.com or related pages.

1.2 The agreement is made between you and Luxx Commerce ApS, operating the FIVE LUXX brand.

2. Eligibility to Purchase

2.1 To place an order, you must be at least the age of majority in your jurisdiction or have permission from a parent or legal guardian.

2.2 By placing an order, you confirm that the information you provide is accurate and that you are legally able to enter into a binding agreement.

3. Account and Access

3.1 You may be able to create or use a customer account as part of the Services. You are responsible for keeping your login details confidential and for all activity carried out through your account.

3.2 You must not misuse the Services, interfere with website security, attempt unauthorized access, submit false information, or use the Services for unlawful purposes.

4. Contract Formation

4.1 When you place an order, you make an offer to purchase the selected product(s). A binding purchase agreement is formed only when we confirm your order by email.

4.2 We may refuse, cancel, or review an order before confirmation or fulfillment where reasonably necessary, including where products are unavailable, payment authorization fails, pricing or product information is incorrect, address details cannot be verified, or potential fraud or misuse is suspected.

4.3 If you do not receive an order confirmation, please check your spam or junk folder and confirm that the email address entered at checkout was correct. If you still cannot locate it, please contact us through our Contact page.

5. Prices, Taxes, and Payment

5.1 Prices are shown in the currency displayed at checkout and include VAT or similar taxes where applicable, unless otherwise stated.

5.2 Shipping fees, customs duties, import taxes, brokerage fees, and other local charges may apply depending on your destination and the shipping setup. Where applicable, charges are shown at checkout or handled as described in our Shipping Policy and Country List.

5.3 Accepted payment methods are those displayed at checkout. Payment must be authorized at the time of order. We may cancel an order if payment authorization fails or is reversed.

5.4 Prices, promotions, discounts, product availability, and shipping options may change without notice. The price applicable to your order is the price shown at checkout when you place the order, subject to correction of obvious errors.

6. Product Information and Availability

6.1 We make reasonable efforts to display product descriptions, images, colours, sizing information, materials, availability, and pricing accurately.

6.2 Product colours, fit, finish, size perception, and appearance may vary depending on your device, screen settings, lighting, supplier information, production batch, or product type.

6.3 Product information may be updated from time to time. We may limit quantities, discontinue products, or change availability at our discretion.

6.4 If an item becomes unavailable after you place an order, we may ship the available items and refund the unavailable item(s), or cancel and refund the affected order if fulfillment is not possible.

7. Orders, Processing, and Shipping

7.1 Order processing, dispatch, tracking, shipping fees, delivery estimates, customs information, failed deliveries, and delivery-related issues are handled under our Shipping Policy.

7.2 Destination-specific shipping information is set out in our Country List.

7.3 Delivery estimates are not guaranteed delivery dates. Delays may occur due to carrier operations, customs processing, address issues, high-volume periods, weather, public holidays, or other circumstances outside our reasonable control.

8. Risk and Ownership

8.1 Ownership of the goods transfers to you when full payment has been received.

8.2 Risk of loss or damage transfers to you upon delivery of the goods, subject to mandatory consumer protection rules that may apply.

9. Right of Withdrawal, Returns, and Refunds

9.1 If you are a consumer, you may have a statutory right to withdraw from your purchase within 14 days of receiving the goods, subject to applicable legal exceptions.

9.2 The applicable return conditions, return process, return costs, refund options, and exclusions are described in our Refund Policy. FIVE LUXX does not offer an extended return period beyond the statutory 14-day withdrawal period.

9.3 Returned items must meet the conditions stated in the Refund Policy. For fashion, footwear, apparel, and accessories, this normally means that items must be unused, unworn, unwashed, undamaged, and returned with tags and original packaging where applicable.

9.4 If you handle an item beyond what is necessary to establish its nature, characteristics, and functioning, we may reduce the refund to reflect any loss in value, where permitted by law.

9.5 FIVE LUXX does not currently offer direct exchanges. If you would like a different size, colour, or product, please return the original item in accordance with our Refund Policy and place a new order.

10. Defective, Damaged, Incorrect, or Non-Compliant Items

10.1 If you receive an item that is faulty, damaged, incorrect, incomplete, or not in conformity with your order, please contact us as soon as possible through our Contact page or at support@fiveluxx.com.

10.2 We may request photos of the item, packaging, and shipping label so we can assess the issue and provide an appropriate solution.

10.3 Consumers may have statutory rights in relation to defective or non-compliant goods. Nothing in these Terms limits those mandatory rights.

11. Reviews, Feedback, and User Content

11.1 If you submit reviews, feedback, suggestions, images, or other content to us or through the Services, you confirm that you have the necessary rights to do so and that the content is not unlawful, misleading, offensive, or infringing.

11.2 Where permitted by law, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, display, and adapt such content for business, marketing, customer service, and operational purposes.

12. Privacy and Personal Data

12.1 Luxx Commerce ApS is the data controller responsible for personal data processed in connection with the Services, unless otherwise stated.

12.2 Personal data is processed in accordance with our Privacy Policy. Privacy-related requests may be sent to gdpr@fiveluxx.com.

13. Third-Party Tools and Links

13.1 The Services may contain links to third-party websites, payment providers, shipping providers, social media platforms, analytics tools, or other external services.

13.2 We are not responsible for third-party websites, services, terms, privacy practices, or content. Your use of third-party services may be subject to their own terms and policies.

14. Intellectual Property

14.1 All content on the Services, including text, images, graphics, logos, design elements, product presentation, layout, and other materials, is owned by Luxx Commerce ApS, its licensors, suppliers, or relevant rights holders, unless otherwise stated.

14.2 You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, scrape, copy, or commercially exploit any content without prior written permission.

15. Errors, Inaccuracies, and Omissions

15.1 We may correct errors, inaccuracies, or omissions at any time, including after an order has been submitted.

15.2 Where an obvious pricing, product, stock, or technical error affects an order, we may cancel the affected order and refund any amount paid, unless otherwise required by law.

16. Reserved Rights and Misuse

16.1 To protect customers and our business, we may limit, refuse, cancel, or review orders, returns, accounts, or access to the Services where we reasonably suspect fraud, policy misuse, unauthorized payment activity, excessive or irregular return activity, false information, abuse, or other unlawful or harmful conduct.

16.2 Nothing in this section limits any mandatory consumer rights that may apply.

17. Disclaimer and Limitation of Liability

17.1 The Services are provided on an “as is” and “as available” basis, except where mandatory law provides otherwise.

17.2 To the fullest extent permitted by law, Luxx Commerce ApS and FIVE LUXX are not liable for indirect, incidental, special, punitive, or consequential losses, including loss of profits, loss of data, loss of goodwill, or business interruption.

17.3 Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, including liability for fraud, fraudulent misrepresentation, or personal injury caused by negligence where applicable.

18. Governing Law and Jurisdiction

18.1 These Terms are governed by Danish law and applicable mandatory consumer protection rules.

18.2 If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence. These Terms do not remove those mandatory rights.

18.3 Disputes should first be raised with us so we can attempt to resolve the matter amicably.

19. Complaints and Dispute Resolution

19.1 If you have a complaint, please contact us first via our Contact page or at support@fiveluxx.com.

19.2 If a complaint cannot be resolved directly, you may have access to relevant consumer complaint bodies or alternative dispute resolution mechanisms depending on your country of residence and the nature of the dispute.

19.3 For Denmark, information about the public consumer complaints system is available through the Danish authorities. The European Commission also maintains information about consumer redress and dispute resolution bodies in participating countries. The former EU Online Dispute Resolution platform has been discontinued and should not be relied on for new complaints.

20. Changes to These Terms

20.1 We may update these Terms from time to time to reflect changes in our business, legal requirements, operational setup, or the Services.

20.2 The updated version will be published on the Website with an updated date. The version in force at the time of your purchase will apply to that purchase unless mandatory law requires otherwise.

21. Severability and Entire Agreement

21.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

21.2 These Terms, together with the policies referenced in them, form the agreement between you and Luxx Commerce ApS regarding your use of the Services and purchases from FIVE LUXX.
